Terms of Service

1. Acceptance of Terms

By accessing or using SonicVerse AI Studio ("the Service"), operated by Rogue Wave Productions ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SonicVerse AI Studio is an AI-powered music production platform that provides tools for music generation, voice cloning, stem separation, mixing, mastering, video creation, and related audio production services. The Service is provided on a subscription and pay-as-you-go credit basis.

3. User Accounts

You must create an account to access most features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent.

4. Subscriptions and Credits

Paid subscriptions are billed monthly through our payment processor (Stripe) via Rogue Wave Productions. Pay-As-You-Go credits are non-refundable and do not expire. Subscription benefits apply only during the active billing period. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

5. Content Ownership and Licensing

Your Content: You retain ownership of original content you create using the Service (lyrics you write, vocals you record, instruments you play). AI-generated content is licensed to you according to your subscription tier.

AI-Generated Content: Content generated by our AI tools is provided under a license that varies by subscription tier. Free-tier users receive a personal, non-commercial license. Paid-tier users receive commercial usage rights as described in their plan.

Catalog Submissions: When you submit content to the Rogue Wave catalog, you grant Rogue Wave Productions a non-exclusive license to distribute and license your content. Revenue splits are determined by your subscription tier at the time of submission. You may request removal of your content from the catalog at any time, subject to existing licensing agreements.

6. Acceptable Use

You agree not to:

• Use the Service to create content that infringes on third-party intellectual property rights
• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to reverse-engineer, decompile, or extract AI models or algorithms
• Use automated scripts or bots to access the Service beyond normal usage
• Resell, sublicense, or redistribute the Service itself
• Impersonate another person or entity through voice cloning or other tools
• Use voice cloning features on voices you do not have rights to clone

7. AI-Generated Content Disclaimer

AI-generated music, lyrics, and media may occasionally produce content that resembles existing copyrighted works. We do not guarantee that AI-generated content is free from similarity to existing works. You are responsible for reviewing generated content before commercial use. We are not liable for copyright claims arising from AI-generated content.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Third-party API providers (for music generation, voice synthesis, video creation, etc.) may experience downtime outside our control. Credits will not be deducted for failed generations.

9. Termination

We may suspend or terminate your account for violation of these Terms. You may cancel your subscription at any time through the Rogue Wave Productions billing portal. Upon termination, your access to subscription features will end, but your created content remains accessible for 30 days for download.

10. Limitation of Liability

To the maximum extent permitted by law, Rogue Wave Productions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
